Just a quick thought, I can think of two possible work around options that may (or may not) fly, Eduardo.

1) Call the game DKA, and leave it at that to avoid red flagging the title. After all, Champ Kong got away with it. :)

2) "sell" Opcode's DKA", with "Coleco's SGM included!"-- just keep the branding of items separated. :) That may also work if you choose to offer the SGM separately for future titles or replacement units. (While I can't imagine that world, there may be some who don't really care for DKA as their only SGM game. Just like Coleco didn't think the French market would want Baseball with the SAC's, I guess. lol)

A couple things I noticed in the spot, too... The first 'game screen' shot (as well as the actual TV over the real Mario's shoulder) is missing the clocks and scoreboard. And while I can't make out the joystick very well, it appears the guy is playing using either the keypad or a gamedisc on the lower part a la Intellivision.
